Russian Government at the end of July 2013The Law on Water Supply and Drainage was approved. This project is designed to regulate the conditions for the provision of the relevant type of services. The Regulations stipulate the rules of water supply and sanitation. In this article you can read them.
Current requirements govern relationshipsexecutive authorities of both federal importance and subjects of the Russian Federation. Moreover, these standards apply to settlements and cities with local government, to institutions providing water disposal and water supply, as well as transportation (including drains). However, this includes any other coordinating activities in this area. These include the provision of cold water (centralized and non-centralized water supply systems), both drinking and technical purposes. Moreover, these orders also apply to drains that enter the central pipeline system.
It should be noted separately that the relationship betweenThe water supply and sewerage industry and the owners (users) of the dwelling (both in the apartment building and in the private sector) regulate the Federal Law on Water Supply and Drainage only in a part that is not regulated by housing legislation. The same conditions apply to housing cooperatives (including consumer associations of any other specialization) and homeowner and apartment owners associations. In addition, these circumstances apply to management companies whose work consists in the provision of utilities, including cold water supply and drainage to the owners (users) of the above premises.
The current Law "On Water Supply and Sanitation" establishes and explains a number of concepts. Consider some of them. The position highlights the following points:
one."Borders of balance" - represent the lines that carry out the separation of water supply and sanitation. They pass between the owners in accordance with the sign of ownership or ownership on other legal grounds. There is a separation between the objects in relation not only to centralized systems, but also to sewer and water supply networks.
2."Accident" is an event that is extremely dangerous. Usually leads to the fact that water supply and wastewater is completely or partially terminated. And in most cases it carries a threat to the environment, as well as to human health. And it does not matter where the catastrophe occurred - on central, sewer or water supply systems (including individual objects).
3.The "control sample" is the analysis of wastewater that enters the central pipeline. It is carried out to accurately determine the properties and composition of the selected liquid. The fence is made from the sewer control well.
four.A “transit organization” is an institution that provides a water diversion service. An event of this kind also transports wastewater. For this purpose, use its own water supply and sanitation. It should be noted that an individual entrepreneur can also act in the person of this organization.
five.The “control well” is a well that is designed to collect wastewater from the consumer. It is necessarily stipulated either in a separate contract, or in a single agreement on water supply and sanitation, or in another contract. In addition, the last well located on the pipeline’s route from the consumer can also be used as a collection tank. However, only if it is not embedded in the central tube.
6. "Surface wastewater" - this is all that enters the system of water disposal from the environment. Namely: thawed, drainage, rain, watering and infiltration emissions.
In the event of a dangerous situationspecial requirements are established, in accordance with which water supply and water disposal are provided. The SNiP contains technical regulations and standards (of both a state and national character). In addition, there is a specially designed instruction. It regulates work with the drinking water system during an emergency.
Since water supply and sanitation is carried out on the basis of an agreement, there is a certain procedure for its preparation.
1. When a central pipeline is used, 3 types of contracts can be signed. Agreements are made separately for the supply or drainage. There is also a general agreement.
2Transactions of this kind are always concluded in accordance with accepted models established by the Russian Government. This document is certified, on the one hand, by the subscriber, and on the other, by a representative of the organization providing the service. In the agreement, among other things, may be specified rates for water supply and sewage.
3.In the case when local governments, in order to provide the client with cold water and sewage networks, involve a third-party organization as a guarantor, the above agreements are concluded directly with it.
four.During the absence of the delegating party, subscribers can sign contracts (including contracts of a uniform nature) with the institution to whose pipeline or sewage system their facilities are connected.
Water Supply and Wastewater Contractit is concluded only after the client submits an application (subscriber’s request). Either upon receipt of a similar offer from a service provider or guaranteeing organization (if any). It should be noted that in the case when the employer cannot be personally present at the conclusion of the agreement, an authorized representative can sign all the papers on his behalf. However, to perform such actions is possible only with a power of attorney.
From the moment the subscriber submits the application to the organization,providing services of plumbing nature, for its consideration is given 20 days. In the case of a partial absence of the required information (documents) within 5 working days (from the day of filing the application), the client receives a notification about the need to provide the institution with missing information. As soon as such a message is sent to the applicant, consideration of the materials is suspended - until all necessary information is received. These conditions are provided for by the current requirements (16 and 17 points). Water and sewer institution has every right to stop considering the option of connecting the subscriber to the pipeline or sewage system and return all documents to him with an indication of the exact reason. It is worth noting that such actions are possible only if the required information is not provided in time (that is, within 20 days from the time the notification was sent).
When a service company, eitherthe guaranteeing organization (after choosing one) makes a decision on concluding a transaction, the subscriber is sent a draft of the relevant agreement in 2 copies, which, among other things, contains a water supply and wastewater disposal scheme. The client receives these documents regardless of the type of agreement. A package of papers is one in the event that a person enters into a contract only for the provision of cold water or for using the sewer system, or signs a general contract. The preparation of this document is carried out on the basis of type samples, which were reviewed and approved by the Russian government.
В том случае, когда в the water and sewer organization receives applications from several subscribers for connection to the central pipeline of the same object, consideration of this issue may be suspended. At the same time, certain terms are set. If the institution decides to suspend the consideration of applications, all clients who have submitted documents undertake to submit proof of their authority to sign an agreement on cold water supply and sanitation (or a general agreement) for 30 days. That is, submit an extract from the Unified State Register to the property indicated in circulation. If the required documents (confirming the client's authority) are not submitted within the prescribed period, the water company has the right to stop accepting the application and return it to the subscriber, indicating the reason. On the other hand, if the submitted documents comply with the current rules, the organization undertakes to send the client the draft contracts (approved by the Russian Government) in 2 copies within 20 days from the date of their receipt.
Subscriber after receiving the relevant papers notafter 30 days, must sign them and send one sample to the institution to which it will be connected to the waste system or pipeline. When an authorized person acts on behalf of a client, evidence must be provided along with the documents confirming the authority of the person. If during the specified period the client did not return the draft contracts to the organization, then they are considered to be concluded on the conditions specified in the documents. The same decision is made in the event of a late proposal for amending the agreement developed. It is worth noting that amendments to the document are considered only when they do not contradict the adopted law.
Since the receipt of the draft contracts forconnection to the drain system or the central pipeline the subscriber has the right to make a proposal to change the submitted papers for 30 days. However, these corrections should not contradict the Federal Law, as well as the current requirements and types adopted by the Russian government. The client sends the appropriate adjustments to the organization with which the contract is concluded, in any convenient way. The main thing is that the subscriber received confirmation of the delivery of these documents.
When establishment, to the pipeline and sewagethe system of which the client plans to connect, receives a contract with the specified amendments, it undertakes to consider them within 5 days. Moreover, within the specified period, the company must take the necessary measures to eliminate all disagreements and return the subscriber for familiarization and signing new agreements. The client, for his part, from the moment of receipt of the corrected documents undertakes to review and sign both copies of the new contract in the same time period. In the event that the organization fails to make these changes, as well as the late provision of the amended agreements, the applicant has the right to go to court. At the same time, he can put forward demands for forcing the company to enter into a contract.
The transaction between the client and the company providingwater supply and sanitation, is for a certain period, which is indicated in the agreement. If 30 days before the expiration of this date, neither party notifies of its termination, the validity period of these documents will be extended for the same time period. It should be noted that the same conditions apply to the introduction of possible changes or to the conclusion of a contract with new requirements.
At the beginning of 2014 for the population of Moscowcertain tariffs for water supply and sanitation have been established (this applies to all residents of the region, except for Novomoskovsky and Troitsky districts). Cold water costs 28.40 per cubic meter, drainage - 20.15. Prices at the end of the year will be slightly higher. As of November 2014, the cost of a cubic meter of cold water will be 29.16, water removal - 20.69.
